Gas Gift Card Contest Guidelines

GENERAL

1. This contest (“Contest”) is sponsored by Canada Drives Ltd. (“Sponsor”). The Contest is not sponsored, endorsed or administered by, or associated with, Instagram.

2. By participating in this Contest, each contest entrant (“Entrant”) acknowledges compliance with, and agrees to be bound by, these Contest Guidelines.

ELIGIBILITY

3. Only Entrants who abide by these Contest Guidelines are eligible to win the prize. Entrants who do not comply with any of the Contest Guidelines may be subject to disqualification by the Sponsor, in Sponsor’s sole discretion.

4. The Contest is open to legal residents of Canada, excluding the province of Quebec, who have reached the age of majority in their province of residence at the time of entry.

5. The Contest is not open to employees (or their immediate family members, or people living in their same household) of the Sponsor, its parent, related and affiliated companies, subsidiaries, departments or agencies, franchisees, suppliers, advertising and promotional agencies, contest administrators, or any other parties engaged in the development, production or distribution of Contest materials (collectively, the “Contest Parties”).

CONTEST PERIOD

6. The Contest begins on July 25, 2022 at 12:00 p.m. PT and ends on August 2, 2022 11:59 p.m. PT (“Contest Period”).

HOW TO PARTICIPATE

7. NO PURCHASE IS NECESSARY to participate in the Contest.

8. One (1) entry in the Contest is earned by:

   (a) following the Sponsor Instagram account @canadadrives (“Instagram Account”);

   (b) liking the Instagram Account’s post dated July 25, 2022 (the “July 25, 2022 Post”), which introduces the Contest and links to these Contest Guidelines; and

   (c) tagging a friend in the comments section of the July 25, 2022 Post.

9. Entry is automatic as a result of following, liking, and tagging (in 8 (a), (b), and (c)).

10. A bonus entry can be earned by tagging an additional friend in the comments section of the July 25, 2022 Post. There is no limit on the number of additional friends tagged.

11. Any attempt or suspected attempt to use robotic, automatic, programmed or otherwise illicit means to enter the Contest, for example, but not limited to, creating multiple accounts, shall, in the Sponsor’s sole discretion be deemed as tampering and may disqualify an Entrant from entering, participating in or winning the Contest.

TAGGED FRIEND

12. When the Entrant tags a friend (or friends) as described in the How to Participate section, the Entrant represents and warrants that the tagged friend (or friends) is a person (or are people) with whom the Entrant has a Family Relationship or Personal Relationship or the Entrant is otherwise in compliance with Canada’s Anti-Spam Legislation. The Entrant has a “Family Relationship” with someone if the Entrant is related to him/her through marriage, common-law partnership or any legal parent-child relationship and the Entrant has had direct, voluntary, two-way communications with him/her. The Entrant has a “Personal Relationship” with someone if (a) the Entrant has had direct, voluntary, two-way communications with him/her, and (b) it would be reasonable to conclude that the Entrant has a personal relationship, taking into consideration any relevant factors (such as whether the Entrant shares interests, experiences, opinions and information with him/her, as evidenced in the communications, the frequency of the Entrant’s communications with him/her, the length of time since the Entrant last communicated with him/her or whether the Entrant has met him/her in person).

PRIZE

13. There is a total of one (1) prize is available to be won: $500 gas gift card redeemable at participating gas stations in Canada (approximate retail value: CAD$500).

14. The prize must be accepted as awarded and may not be substituted, transferred or redeemed for cash or otherwise, except at the Sponsor’s sole discretion.

15. The Sponsor reserves the right, at its sole discretion, to substitute a prize of greater or equivalent monetary value if the prize cannot be awarded as described for any reason.

16. The Sponsor will not replace the prize if it is lost or stolen.

17. Any costs or expenses associated with the prizes not specified herein will be the responsibility of the selected winner.

WINNING

18. Odds of winning depend on the number of valid entries received during the Contest Period.

19. On August 2, 2022, the Sponsor, or an employee, agent or other representative of the Sponsor, will conduct a random draw from all eligible entries received during the Contest Period and select the potential winner (“Selected Entrant”).

20. The Selected Entrant will be notified within 24 hours of selection via direct message on Instagram from the Instagram Account. The direct message will request contact details from the Selected Entrant.

21. The Selected Entrant must reply to the Instagram Account via direct message on Instagram (or as otherwise directed by the Sponsor) within 7 days of being notified.

22. The Selected Entrant will receive a Declaration and Release Form from the Sponsor by email, which the Selected Entrant must agree to, complete and return by email. By agreeing to the Declaration and Release Form, the Selected Entrant will (among other things): (i) confirm compliance with these Contest Guidelines; (ii) acknowledge acceptance of the prize as awarded; (iii) release the Contest Parties, Instagram and each of their respective officers, directors, agents, representatives, successors and assigns (collectively, the “Releasees”) from any and all liability in connection with the Contest, their participation therein and/or the awarding and use/misuse of the prize or any portion thereof; and (iv) agree to the publication, reproduction and/or other use of their name, address, voice, statements about the Contest and/or photograph or other likeness without further notice or compensation, in any publicity or advertisement carried out by or on behalf of the Sponsor any manner whatsoever, including print, broadcast or the Internet.

23. The Selected Entrant will be required, as a condition of winning the prize, to correctly answer, without assistance of any kind, the Sponsor’s time-limited, mathematical skill-testing question, which may, in the sole and absolute discretion of the Sponsor, be administered online, by email or other electronic means, by telephone, or in the Release. The Sponsor reserves the right, in its sole and absolute discretion, to administer an alternate test of skill as it deems appropriate or necessary to comply with applicable law.

24. Before being declared a winner, the Selected Entrant will be required to: (i) correctly answer the Sponsor’s skill-testing question; (ii) sign and return the Declaration and Release Form within three (3) days of when it is marked as having been sent to the Selected Entrant; and (iii) comply with all other Contest Guidelines, all in the sole discretion of Sponsor. If the Selected Entrant does not meet these criteria, they will be disqualified and will not receive a prize and another entrant will be selected by way of a random draw from the remaining eligible entries. 

25. The Selected Entrant may be required to provide proof that they are the authorized Instagram account holder associated with a selected entry.

OTHER CONDITIONS

26. The Releasees will not be liable for: (i) any failure of any website or any platform during the Contest; (ii) any technical malfunction or other problems of any nature whatsoever, including, without limitation, those relating to the telephone network or lines, computer on-line systems, servers, access providers, computer equipment or software; (iii) the failure of any entry to be received, captured or recorded for any reason whatsoever, including, but not limited to, technical problems or traffic congestion on the internet or at any website; (iv) any injury or damage to an Entrant’s or any other person’s computer or other device related to or resulting from participating in the Contest; (v) anyone being incorrectly and/or mistakenly identified as a winner or eligible winner; (vi) any stolen, lost, late, misdirected, damaged prize, and/or (vii) any combination of the above.

27. By entering this Contest, each Entrant expressly consents to the Sponsor, its agents and/or representatives, collecting, storing, sharing and using the personal information submitted for the purpose of administering the Contest and in accordance with Sponsor’s privacy policy (available at: https://www.canadadrives.ca/legal-agreements, unless the Entrant otherwise agrees.

28. The Sponsor reserves the right, in its sole discretion, to amend or modify these Contest Guidelines, or modify, cancel or suspend the Contest, without prior notice for any reason whatsoever,

29. Any and all taxes on any prize awarded, including income taxes, and any incidental expenses associated with collection of the prize, are the sole responsibility of the winner.

30. By entering the Contest, the winner releases the Releasees from any and all actions, proceedings, suits, liability, losses, costs, expenses (including legal fees and disbursements), damages, demands and claims of any kind, including direct, indirect, incidental, consequential or punitive damages, arising out of, or in connection with, this Contest and the awarding of any prize, now or in the future.

31. The Sponsor reserves the right to adjust any of the dates, timeframes and/or other Contest mechanics stipulated in these Contest Guidelines, to the extent deemed necessary by Sponsor, for purposes of verifying compliance by any Entrant, entry or other information with these Contest Guidelines, or as a result of any technical or other problems, or in light of any other circumstances which, in the opinion of the Sponsor, in its sole and absolute discretion, affect the proper administration of the Contest as contemplated in these Contest Guidelines, or for any other reason.

32. The invalidity or unenforceability of any provision of these Contest Guidelines shall not affect the validity or enforceability of any other provision. In the event that any provision is determined to be invalid or otherwise unenforceable or illegal, these Contest Guidelines shall otherwise remain in effect and shall be construed in accordance with the terms as if the invalid or illegal provision were not contained herein. 

33. To the fullest extent permitted by applicable law, all issues and questions concerning the construction, validity, interpretation and enforceability of these Contest Guidelines or the rights and obligations of participants, Sponsor or any of the other the Releasees in connection with the Contest will be governed by and construed in accordance with the domestic laws of the Province of British Columbia and the federal laws of Canada applicable therein, without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of any other jurisdiction’s laws. The parties hereby consent to the exclusive jurisdiction and venue of the courts located in British Columbia in any action to enforce (or otherwise relating to) these Rules or relating to this Contest.
